Extensive program materials lay a foundation of the basic principles and concepts of performance-based awards and then build on that foundation to introduce increasingly more complex regulatory and administrative nuances, exceptions, and varying interpretations.   • Special tax law considerations, including tax withholding and reporting challenges unique to performance-based awards, how to maximize tax deductions under Section 162(m), and Section 409A considerations.
  • Accounting treatment of performance plans, including valuation and earnings per share. Measurement of expense, attribution, and treatment of forfeitures. How to minimize the earnings impact under 123R and disclosure obligations.
  • Best practices for accurate and efficient performance plan administration, including how to design effective communication programs so that participants understand what you want to them to achieve.
  • Complexities related to global plans and solutions to these hurdles.
